The contract between Gagliapac and the Customer is concluded exclusively online, by sending an order following the procedure indicated on the Site.<\/p><div><hr \/><\/div><p><strong>Art. 2 \u2013 Pre-contractual information<\/strong> Before confirming the purchase, the Customer is required to carefully examine all the characteristics of the Products, which are described in the relevant information sheets. Furthermore, the Customer declares to have been clearly informed about:<\/p><ul data-spread=\"false\"><li>the price of the Products, including details of any additional costs such as shipping charges, VAT and other applicable taxes;<\/li><li>the available payment methods;<\/li><li>the conditions, terms and procedures for exercising the right of withdrawal;<\/li><li>the applicable guarantees;<\/li><li>the applicable law and the competent Court.<\/li><\/ul><p>Sending an order implies full acceptance of these General Conditions. The Customer is responsible for carefully checking the data provided in the order confirmation and reporting any errors to Gagliapac within 24 hours of sending the confirmation itself.<\/p><p>The Customer guarantees to be at least 18 years old and have the legal capacity to enter into binding contracts, in the event that the order is placed as a natural person. The insertion of false, invented or imaginary data is prohibited and will result in possible legal action by Gagliapac.<\/p><div><hr \/><\/div><p><strong>\u00a0<\/strong><\/p><p><strong>Art. 3 \u2013 Orders<\/strong> To purchase the Products, the Customer must place an order through the Site following the guided procedure. After completing the payment, the Customer will receive a confirmation by e-mail containing a summary of the order.<\/p><p>The personal data provided for payment will be used exclusively for the management of the order and related invoicing, while the data relating to the payment itself will be processed directly by the secure electronic payment systems provided by the banking institutions collaborating with Gagliapac.<\/p><p>Gagliapac cannot be held responsible for any fraudulent or unauthorized use of credit cards or other payment instruments by third parties.<\/p><div><hr \/><\/div><p><strong>\u00a0<\/strong><\/p><p><strong>Art. 4 \u2013 Prices and shipping costs and methods<\/strong> The prices of the Products are expressed in Euros and are net of VAT and any additional costs such as the CONAI contribution. These prices may vary, but the Customer will be required to pay the price indicated at the time of sending the order.<b> The minimum order required is \u20ac35.\u00a0<\/b><\/p><p>Shipping costs are calculated based on the selected delivery method, destination, number and weight of packages. These costs will be visible during the purchase process. <b>Starting from \u20ac35<\/b> Shipping costs are free.\u00a0<\/p><p>All orders received after 12:00 on Friday will be processed and shipped on Monday of the following week.<\/p><div><hr \/><\/div><p><strong>\u00a0<\/strong><\/p><p><strong>Art. 5 \u2013 Payment Methods<\/strong> The Customer can choose between different payment methods, including:<\/p><ul data-spread=\"false\"><li>credit card;<\/li><li>bank transfer;<\/li><li>immediate bank transfer;<\/li><li><span style=\"background-color: transparent; color: var( --e-global-color-text ); font-family: var( --e-global-typography-b2ce6af-font-family ), Sans-serif;\">PayPal.<\/span><\/li><\/ul><p>All transactions take place on secure platforms, which guarantee the protection of the Customer&#039;s data through advanced cryptographic protocols. In case of payment by card, the charge is made at the time of order confirmation.<\/p><div><hr \/><\/div><p data-pm-slice=\"1 1 []\"><strong>\u00a0<\/strong><\/p><p data-pm-slice=\"1 1 []\"><strong>Art. 6 \u2013 Right of withdrawal<\/strong> The Customer who qualifies as a Consumer, pursuant to the Consumer Code, may withdraw from the contract within 14 days of receiving the Products, without having to provide a reason.<\/p><p>The 7-day period is calculated as follows:<\/p><ul data-spread=\"false\"><li>For service contracts, from the day of conclusion of the contract;<\/li><li>For sales contracts, from the day on which the Customer or a third party designated by him physically receives the Products.<\/li><\/ul><p>To exercise the right of withdrawal, the Customer must communicate his decision to Gagliapac using one of the following methods:<\/p><ul data-spread=\"false\"><li>By telephone, on 0761 518111;<\/li><li>By email, to the address <a>info@gagliapac.it<\/a>.<\/li><\/ul><p>The costs of returning the Products will be borne by the customer, subject to approval of the withdrawal request and organization of the collection by a logistics partner in charge. The Customer is required to keep proof of delivery of the Products to the carrier.<\/p><div><hr \/><\/div><p data-pm-slice=\"1 1 []\"><strong>\u00a0<\/strong><\/p><p data-pm-slice=\"1 1 []\"><strong>Art. 7 \u2013 Delivery methods<\/strong> Gagliapac uses specialized carriers to deliver the products purchased by customers. The order is processed and handed over to the carrier within 24 hours of payment being received, and the carrier delivers within the following 48 hours. These times may vary based on the destination, product type, order amount and volume, and in the event of national holidays, natural disasters, and other periods of structural congestion in the national shipping system.<\/p><p>The times indicated on the Site are calculated in working days. Any delays due to incorrect communication of addresses or other information necessary for delivery will not be attributable to Gagliapac.<\/p><p>The goods travel at the Customer&#039;s risk. Gagliapac cannot be held responsible for damages, breakdowns, delays or other problems that may occur during transport.<\/p><p>Upon delivery, the Customer is required to verify in the presence of the carrier that:<\/p><ul data-spread=\"false\"><li>the quantity and type of Products correspond to what is reported in the transport document;<\/li><li>the packaging is intact and shows no signs of tampering or damage;<\/li><li>the Products received are compliant with the order placed.<\/li><\/ul><p>In case of obvious anomalies or damages, the Customer must promptly inform Gagliapac by email to the address <a>info@gagliapac.it<\/a> or by registered letter with return receipt within 24 hours.<\/p><p>For each completed order, Gagliapac issues an invoice that will be sent by email or included in the package.<\/p><div><hr \/><\/div><p><strong>\u00a0<\/strong><\/p><p><strong>Art. 8 \u2013 Warranty<\/strong> <strong>8.1. Product Conformity<\/strong> Pursuant to art. 130 of the Consumer Code, Gagliapac is responsible for any defects of conformity present at the time of delivery of the Product. In such cases, the Customer has the right to repair or replacement of the goods without additional costs, or to a reduction in price or termination of the contract, as provided for in paragraphs 3, 4, 5 and 6 of art. 130 of the Consumer Code. Minor defects for which repair or replacement is impossible or excessively expensive do not give the right to termination of the contract.<\/p><p><strong>8.2. Duration of the Warranty<\/strong> The guarantee for defects of conformity is valid for two years from delivery of the Product, provided that the Customer informs Gagliapac of the defect within two months of discovery, as provided for by art. 132 of the Consumer Code.<\/p><p><strong>8.3. Necessary documentation<\/strong> To avail of the guarantee, the Customer must provide proof of purchase and document the actual delivery of the Product.<\/p><p><strong>8.4. Guarantee for Professionals<\/strong> For Customers who fall within the definition of \u201cprofessional\u201d pursuant to art. 3 paragraph 1 letter c) of the Consumer Code, the guarantee provided by the civil code applies, valid for one year from delivery of the Product, provided that the defect is reported within eight days of discovery.<\/p><p><strong>8.5. Limitations<\/strong> The Products sold by Gagliapac comply with Italian and European regulations. Any differences of a non-substantial nature between the images on the Site and the Product received do not constitute a breach of contract.<\/p><div><hr \/><\/div><p><strong>\u00a0<\/strong><\/p><p><strong>TO<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-b2ce6af-font-family ), Sans-serif; font-size: var( --e-global-typography-b2ce6af-font-size );\">rt. 10 \u2013 Applicable law and competent court<\/strong><span style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-b2ce6af-font-family ), Sans-serif; font-size: var( --e-global-typography-b2ce6af-font-size );\"> The contract is governed by Italian law. Any dispute concerning the validity, interpretation or execution of the contract will be under the exclusive jurisdiction of the Court of Viterbo, unless otherwise provided by law applicable to consumers.<\/span><\/p><div><hr \/><\/div><p data-pm-slice=\"1 1 []\"><strong>\u00a0<\/strong><\/p><p data-pm-slice=\"1 1 []\"><strong>Art. 11 \u2013 Complaint<\/strong> Any complaints must be addressed to Gagliapac, by sending a registered letter with return receipt to the following address: Gagliapac Srl, Localit\u00e0 Quartaccio snc, Fabrica di Roma (VT).<\/p><p>According to art. 49 paragraph 1 letter V of the Consumer Code, the Consumer Customer can avail of the Netcomm Joint Conciliation procedure to manage in an amicable and extrajudicial manner any problems arising from the sale governed by these General Conditions.<\/p><p>The procedure can be started if, after having submitted a complaint to Gagliapac, the Consumer does not receive a response within 30 days or obtains a response deemed unsatisfactory. More information is available at the following link:<\/p><p><a>http:\/\/www.consorzionetcomm.it\/Spazio_Consumatori\/Conciliazione-Paritetica\/Conciliazione-Paritetica.kl<\/a>.<\/p><p>Furthermore, pursuant to art. 14 of EU Regulation 524\/2013, the Consumer Customer is informed that in the event of a dispute it is possible to submit a complaint via the European Union ODR platform, accessible at the following link: <a>http:\/\/ec.europa.eu\/consumers\/odr<\/a>.<\/p><div><hr \/><\/div><p><strong>\u00a0<\/strong><\/p><p><strong>Art. 12 \u2013 Customer Service<\/strong> For assistance requests, Gagliapac can be contacted by telephone at 0761 518111 (Monday to Friday, from 8:30 to 18:30), by e-mail at <a>info@gagliapac.it<\/a> or by using the specific contact form available on the Site.<\/p><div><hr \/><\/div><p><strong>\u00a0<\/strong><\/p><p><strong>Art. 13 \u2013 Contents of the Site and Intellectual Property Rights<\/strong> All contents of the Site, including works, images, photographs, dialogues, music, videos, documents, drawings, logos and materials of any other type, are protected by copyright and any other intellectual property right belonging to Gagliapac or to third parties holding the relevant rights.<\/p><p>Reproduction, modification, duplication, copying or exploitation of the contents of the Site is prohibited without prior written authorization from Gagliapac. Any unauthorized use is prohibited, especially if carried out for commercial or advertising purposes.<\/p><div><hr \/><\/div><p><strong>\u00a0<\/strong><\/p><p><strong>Art. 14 \u2013 Processing of personal data<\/strong> The Customer&#039;s personal data are processed by Gagliapac in compliance with the current legislation on the protection of personal data, as detailed in the Privacy Policy available on the Site.
